NJ Workers' Compensation Rates to Increase in 2023

The NJ Division of Workers' Compensation has announced that the 2023 rates for workers' compensation benefits will increase to a maximum of $1,099.00 per week for temporary and permanent disability and to a minimum of $293.00.

TOTAL PERMANENT DISABILITY: 70 percent of wages
Maximum Rate: $1,099.00 per week
Minimum Rate: $35.00 per week

TEMPORARY DISABILITY: 70% of wages
Maximum Rate: $1,099.00 per week
Minimum Rate: $293.00 per week
Maximum Duration: 400 weeks

Death Benefits: 70% of wages
450 weeks plus spouse's statutory benefits
Maximum Rate: $1099.00

FUNERAL ALLOWANCE: Not to exceed $5,000.00

"Individuals who suffer a disability which is total in character and permanent in quality are entitled to receive 70% of the weekly wages that they earned at the time of their injury subject to a maximum of 75% of the Statewide Average Weekly Wages (SAWW) and a minimum of 20% of the SAWW." Gelman, Jon L, Workers’ Compensation Law, 38 NJPRAC 16.4 (Thomson-Reuters 2022).
