CMS, In A Series of New Q & A's, Announces It Will No Longer Review Settlements Less Than $10,000
On July 11, 2005, CMS published a new set of Questions and Answers concerning the Medicare Secondary Payer Act (MSP).
In the 7 page document CMS indicated that there was no substantive dollar or "safe harbor" threshold for compliance with the federal mandate which requires review of all potential settlements in workers' compensation cases.
However, due to its current "workload review thresholds," new settlements which totaled less than $10,000 would NOT be required to be submitted to CMS for review in compliance with the Medicare Secondary Payer Act.
The CMS has also announced a new fax number to submit WCMSA the proposals.
